Channel X Legal

Channel X is operated by 1st Choice Holdings. "We," "us," and "our" refer to that operator. These policies cover the Channel X site, marketplace, shop, partner tools, and related contact or onboarding flows. Separate contracts, order forms, data processing addenda, pilot statements of work, or marketplace partner terms may add more specific rules for enterprise or managed deployments.

Channel X

Trust & governance

Last updated: April 10, 2026.

This section explains how Channel X thinks about trust, scope, and responsibility. It is written for operators, partners, buyers, and enterprise teams who need a plain view of what Channel X does, what it does not do, and where legal and data obligations sit.

What Channel X covers

Channel X brings together marketing, marketplace discovery, shop and checkout flows, partner onboarding, logistics surfaces, and related enterprise tooling. Some features are public. Others are available only through approved accounts, pilots, partner programs, or enterprise deployments.

What Channel X does not replace by default

Unless a signed agreement says otherwise, Channel X is not automatically your ERP, accounting system, legal system of record, or document archive. Existing systems of record, contract approvals, finance controls, and internal retention obligations remain with you or your designated providers.

Governance model

For the public website, contact flows, account registration, marketplace browsing, and direct commerce experiences we control, Channel X generally acts as the business deciding why and how information is processed. For enterprise, pilot, white-label, or managed deployments, your organization may act as controller while Channel X acts as processor or service provider under the governing contract, data processing addendum, or other written addendum.

Partner and third-party services

Some Channel X flows involve third parties such as payment processors, logistics providers, partner sites, embedded partner experiences, email services, or infrastructure vendors. Those providers only receive the information needed for their role, and their own terms or privacy notices may also apply where they operate as independent providers.

Enterprise addenda and overrides

If you use Channel X through an enterprise agreement, statement of work, seller or buyer onboarding addendum, security review, or data processing addendum, that written agreement may define retention, subprocessor approvals, support commitments, data return or deletion timing, regional handling, audit expectations, and customer instructions more specifically than this public legal hub.

Channel X

Privacy Policy

Last updated: April 10, 2026.

This is the Channel X Privacy Policy. It describes how we collect, use, disclose, and safeguard personal information when you use Channel X, for example when you visit this website, create an account or session, use the marketplace or shop, submit contact or partner forms, or otherwise interact with our services. It should be read together with the Channel X Terms of Use and Cookie notice.

Scope

This policy applies to personal information processed in connection with Channel X websites, applications, and features we control, including commerce, account, support, logistics, and partner experiences linked from our branded properties, unless a more specific notice or signed agreement applies at the point of collection.

Who controls information

For the public Channel X website, marketing pages, contact flows, account registration, and commerce experiences we operate directly, 1st Choice Holdings acts as the controller, business, or similar responsible party for the personal information we collect. For enterprise, pilot, partner, or managed deployments, your organization may act as controller while Channel X acts as processor or service provider where the contract, order form, or data processing addendum says so.

Information we collect

  • Contact and account data: name, email address, phone number, company or organization name, role, login details, and messages you send through our contact, onboarding, or partner forms.
  • Order and transaction data: products purchased, quantities, shipping or billing details you provide, and payment status. Card payments are processed by our payment processors; we do not store full card numbers on our servers.
  • Support and relationship data: records of emails, requests, approvals, account reviews, and other communications with us.
  • Device and usage data: IP address, browser type, general location derived from IP, device type, pages viewed, referring URLs, timestamps, and similar diagnostics that help us operate and secure the site.

How we use information

  • Provide Channel X features, fulfill orders, process payments, send receipts, and respond to support requests.
  • Verify accounts, review approvals, maintain partner access, and support onboarding or logistics coordination.
  • Improve the Channel X experience, analyze aggregate trends, fix errors, and maintain security and fraud prevention.
  • Send transactional emails and business communications relevant to your relationship with Channel X where permitted by law.
  • Comply with law, enforce the Channel X Terms of Use, and protect our rights, users, and partners.

Legal bases where applicable

Depending on your location, we rely on legal bases such as performing a contract, taking steps at your request before contracting, our legitimate interests in running a secure and effective service, consent where required for non-essential technologies or communications, and compliance with legal obligations.

GDPR, UK GDPR, and similar laws

Where these laws apply, we aim to process personal data in line with the principles of lawfulness, fairness, transparency, purpose limitation, data minimization, accuracy, storage limitation, integrity, and confidentiality. For enterprise or managed environments, controller and processor roles are determined by the applicable contract, data processing addendum, or written customer instructions.

Cookies and similar technologies

We use cookies and similar technologies to run essential Channel X features, such as cart or session support where applicable, remember preferences, and understand how the site is used. You can control cookies through your browser settings; disabling certain cookies may limit cart or checkout functionality. See also our Cookie notice.

Sharing of information and subprocessors

We may share information with carefully selected service providers who help us operate Channel X under contract, for example hosting, infrastructure, authentication, payment processing, logistics support, email delivery, security monitoring, and aggregate analytics. They may process information only to the extent needed to perform services for us or our customers under the applicable agreement. We may also disclose information when required by law, court order, or to protect the safety, rights, or property of our users, partners, or business.

International transfers

If information is transferred across borders, we take steps designed to provide an appropriate level of protection consistent with applicable law. Depending on the situation, that can include contractual safeguards, provider commitments, or other lawful transfer mechanisms.

California residents and U.S. state privacy laws

If California or another U.S. state privacy law applies, you may have rights to request access, correction, deletion, or additional disclosures about certain personal information, and to appeal or opt out of certain processing where required by law. Channel X does not sell personal information for money. To exercise available rights, contact us using the information below. We will not discriminate against you for exercising applicable privacy rights.

Children

Channel X services are not directed to children under 16. We do not knowingly collect personal information from children under 16.

Retention

We retain information only as long as needed for the purposes described here, to resolve disputes, enforce agreements, and satisfy legal, tax, accounting, fraud prevention, and security obligations. Unless a contract or law requires a different period, we generally follow this approach:

  • Contact and demo inquiries: typically up to 24 months after the last meaningful interaction.
  • Routine business correspondence and account review records: while the relationship is active, then archived or deleted under the same 24-month standard unless a contract requires more.
  • Security, access, and diagnostic logs: generally 30 to 90 days, unless needed longer for incident review, fraud investigation, abuse prevention, or legal claims.
  • Browser-side storage, session tokens, and cart data on your device: until they expire, are overwritten, or you clear them.
  • Order, billing, tax, and related support records: for the period required by law, accounting standards, or the governing commercial agreement.

Enterprise service data

If Channel X is provided through a pilot, enterprise workspace, white-label deployment, or managed partner program, retention, deletion timing, backups, return of customer data, and approved subprocessors may be governed by the applicable order form, statement of work, security addendum, or data processing addendum.

Your rights

Depending on your jurisdiction, you may have rights to access, correct, delete, restrict, or object to certain processing of your personal information, and in some cases to data portability or to lodge a complaint with a regulator. We may need to verify your identity before acting on a request.

Security

We use reasonable administrative, technical, and organizational measures appropriate to the nature of the information and the risk involved, including access controls, encryption in transit where standard, authentication safeguards, and vendor review where feasible. No online transmission or storage system is completely secure.

Third-party links and embedded services

Channel X may link to or embed third-party websites, partner brands, payment flows, or external services. Their privacy and data practices are governed by their own notices and agreements, not this policy, except to the extent we explicitly say otherwise.

Changes

We may update this Privacy Policy from time to time. We will post the revised version on this page and update the "Last updated" date. Material changes may also be highlighted through the site or relevant account communications where appropriate. Continued use of Channel X after changes constitutes acceptance of the updated policy where permitted by law.

Terms of Use

Last updated: April 10, 2026.

These Terms of Use apply to Channel X, including this website, the marketplace and shop experiences, partner and account tools we make available, and related services.

Agreement to terms

By accessing or using Channel X sites, cart, checkout, or related tools, you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the site.

What this site and service are for

Channel X provides information about our offerings and, where enabled, commerce, account, logistics, and partner tools. Content reflects our view of the service at the time of publication. Nothing on the public site is a promise to deliver a specific feature, result, or service level unless that commitment appears in a separate signed agreement.

Enterprise terms and addenda

If you use Channel X under an enterprise agreement, order form, pilot statement of work, seller or buyer program, onboarding addendum, security review, or data processing addendum, that written agreement may control over these public terms where the documents conflict.

Not professional, legal, or agronomic advice

Content on Channel X is for general information. It is not a substitute for professional advice, applicable laws or regulations in your jurisdiction, or, where relevant, product labeling and safe-use directions. For agricultural or specialty physical products sold through Channel X, content is not a substitute for advice from a qualified agronomist or extension specialist. Always follow the printed package label and applicable law.

Products, pricing, and availability

Where product listings appear on Channel X, descriptions, photographs, analysis statements, specifications, and similar figures are summaries only. The physical label, approved documentation, and applicable law control where they differ.

Prices, fees, taxes, shipping estimates, and availability may change without notice until an order is confirmed. We may refuse or cancel orders in cases of error, suspected fraud, export or compliance concerns, or inventory limits.

Accounts and submissions

You are responsible for keeping your account credentials, approval details, and submitted information accurate and secure. You must not impersonate another person or organization, or submit false or misleading onboarding, order, or contact information.

Orders and payment

When you place an order, you represent that your payment information is accurate and that you are authorized to use the payment method. Payments are processed by third-party payment providers. Your use of those services may be subject to their own terms and privacy policy.

Shipping and returns

Delivery dates and carriers are estimates. Risk of loss passes according to the carrier and our shipping terms stated at checkout or on your order confirmation. Return and refund policies, if any, will be stated at checkout, in order communications, or in a separate seller or partner agreement.

Acceptable use

  • Do not misuse Channel X, attempt unauthorized access, or interfere with other users.
  • Do not use automated means to scrape or overload our systems without permission.
  • Do not introduce malware, spam, fraudulent transactions, or content that infringes the rights of others.
  • You are responsible for the accuracy of information you provide, including shipping address and contact details.

Intellectual property

Channel X trademarks, logos, product names, site content, and design elements are owned by us or our licensors unless otherwise noted. You may not copy, modify, distribute, or create derivative works from them without prior written consent, except for limited personal, non-commercial viewing allowed by law.

Disclaimer of warranties

THE CHANNEL X SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the site will be uninterrupted, error-free, or free from harmful components, or that any information, listing, or availability state will remain current at all times.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM YOUR USE OF CHANNEL X OR PRODUCTS OR SERVICES YOU OBTAIN THROUGH CHANNEL X. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO CHANNEL X OR A PURCHASE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE RELEVANT PURCHASE OR SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS (US$100), UNLESS A DIFFERENT MINIMUM APPLIES UNDER LAW.

Indemnity

You agree to defend and indemnify us against claims arising from your violation of these terms, misuse of Channel X, or violation of others' rights, to the extent permitted by law.

Third-party links and services

Channel X may include links to third-party websites, payment flows, logistics providers, or embedded partner services. We are not responsible for their content, availability, terms, or privacy practices except as required by law or by an express written agreement.

Governing law

These Channel X Terms of Use are governed by the laws of the State of California, without regard to conflict-of-law rules, except where preempted by U.S. federal law or where mandatory consumer protections in your jurisdiction cannot be waived. Exclusive jurisdiction for disputes arising out of or relating to Channel X will be in the state or federal courts located in California, unless a separate written agreement requires another forum.

Severability

If any part of these Terms of Use is held invalid or unenforceable, the remaining provisions will continue in full force and effect to the maximum extent permitted by law.

We may update these Terms of Use from time to time. The "Last updated" date will change when we do. Your continued use of Channel X after posting means you accept the revised terms where allowed by law.

Accessibility

Last updated: April 10, 2026.

This is the Channel X accessibility statement. We are committed to making Channel X web experiences perceivable, operable, understandable, and robust for people with disabilities, consistent with recognized accessibility guidance and applicable law.

Standards we target

We aim to align Channel X with the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA for new and updated experiences where feasible. Accessibility is an ongoing process as content, components, and partner surfaces change over time.

What we consider

Our work includes attention to keyboard navigation, visible focus, text alternatives for meaningful images, semantic structure for headings and landmarks, readable color contrast in core controls where we control styling, and compatibility testing with common assistive technologies where feasible.

Third-party content

Some content or flows may be provided by third parties, such as payment checkout, partner embeds, external documents, or linked services. We encourage accessible practices from those providers but do not fully control their implementations.

Known limitations

Older documents, embedded widgets, or legacy content may not yet meet every accessibility success criterion. We work to identify and improve barriers over time.

Feedback and assistance

If you encounter a barrier when using Channel X, please contact us and describe the page, feature, browser, device, or assistive technology involved. We will review the issue and try to provide information or assistance in a reasonable alternative format where appropriate.
